These Terms and Conditions supplement to another agreement applicable between you and FiddAsia Advisory Ltd., in effect from time to time. Guidelines
In order to use the Platform or the Services, you must be at least 18 years of age. You represent that you have read and understood, and that you agree to be bound by these Terms and Conditions and you are at least 18 years old. Your access to it does not imply a license to reproduce and/or distribute this information which means that you cannot reproduce, modify, publicly display or distribute the contents of this platform without the prior written consent from FiddAsia Advisory Ltd.
Any trademarks and logos displayed on the platform are the registered and unregistered trademarks of their respective owners. Use of the trademarks displayed is strictly prohibited.
User Obligations
You agree to provide truthful information, including but not limited to a member name and password as well as your name, address, telephone number and a valid email address. You agree to provide faultless account information and to update these information as necessary to keep it accurate. You are solely responsible for maintaining the confidentiality of your member name and password and agree to notify us immediately of any unauthorized use of your member name, password or account.
Only advertise properties that are currently available for purchase or lease. Property descriptions and images must be relevant to the property being advertised. All misleading, fake or false information will be removed. You agree that no submissions provided by you to the platform will violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary rights. You are and shall remain solely responsible for the content of any submissions you make. Users must ensure that you do not publish anything that could be perceived to be unlawful, defamatory, fraudulent, misleading or anything protected by copyright.
As a user of the website, you are responsible for checking the accuracy of all details and obtaining the necessary legal advice as and when required.
Users must remove properties or notify FiddAsia Advisory Ltd. when a property has been sold or entered into a lease agreement within 7 days by emailing contact@fiddasia.com
When submitting an enquiry anywhere on our platform, we shall share your details to the relevant property seller. Third parties may include private property owners, real estate agents, developers or other types of property sellers. You agree to be allowed to be contacted by the property seller for the purpose of buying and selling, or leasing of property. Users agree once this initial enquiry has taken place we accept no responsibility or liability for communication between the parties.
- Not to use the platform or services for illegal purposes.
- Not to impersonate any person or entity or to falsely state or otherwise misrepresent your affiliation with any person or entity.
- All Advertising should be compliant with Thailand Advertising Standards and The Laws of Thailand.
- Not to attempt to gain unauthorized access to or otherwise interfere or disrupt other computer systems or networks connected to the platform or services.
- You agree that you will not use automation software, bots, hacks, mods or any other unauthorized third-party software designed to access, crawl, disrupt or collect data from FiddAsia Advisory Ltd. services or platform.
- You agree that you will not use the site in any manner that could damage, disable, overburden, or impair the site or interfere with any other party’s use and enjoyment of the site.Through your usage of this platform, you consent that FiddAsia Advisory Ltd. may gather certain limited information about you and your platform usage.
- FiddAsia Advisory Ltd. is free to use such information as stated in its Privacy Policy. Any information you provided through or in connection with the platform will be treated as non-confidential and non-proprietary.
- Anything you transmit or post becomes the property of FiddAsia Advisory Ltd. or its affiliates who are free to use the information for any purpose.

- FiddAsia Advisory Ltd. will not be responsible for any losses arising out of the unauthorized use of your account and you agree to indemnify and hold harmless FiddAsia Advisory Ltd., its partners, parents, subsidiaries, agents, affiliates and/or licensors, as applicable, for any improper, unauthorized or illegal uses of your account.

FiddAsia Advisory Ltd. uses reasonable efforts to include accurate and up to date information from it’s advertisers on the platform. However, makes no warranties or representations as to its accuracy. In particular, FiddAsia Advisory Ltd. assumes no liability or responsibility for any errors or omissions in the content of the platform known as Fiddasiaestate.com
Everything on the platform is provided on an “as is” basis without any representation, endorsement or warranty of any kind, either express or implied, including, but not limited to, warranties of title, merchantability or fitness for a particular purpose or non-infringement. Technical or System issues that might be acquired on the platform are not our responsibility but we will endeavor to keep outages to an absolute minimum.
We reserve the right to monitor or censor user generated content on our website, although we are not under any obligation to do so.
We reserve the right to remove, suspend, or change the position of any advertisement or listing at any time. Including any alterations to advertisements where we consider it necessary.
Packages may change as we develop our platform, for this we reserve the right to change pricing, subscriptions at any time or to amend the terms of the contract. In such events, you will have the option of canceling.
Taxes, all package prices are subject to taxes, unless otherwise stated.
We reserve the right to delegate or sub-contract the performance of any of our functions in connection with the Platform and/or Services and reserve the right to use any service providers, subcontractors and/or agents on such terms as we deem appropriate.
No waiver, our failure to enforce these Terms of Conditions shall not constitute a waiver of these terms, and such failure shall not affect the right later to enforce these Terms of Conditions. We should still be entitled to use our rights and remedies in any other situation where you breach these Terms of Conditions.
Force Majeure, we shall not be liable for non-performance, error, interruption or delay in the performance of its obligations under these Terms of Use (or any part thereof) or for any inaccuracy, unreliability or unsuitability of the Platform’s and/or Services’s contents if this is due, in whole or in part, directly or indirectly to an event or failure which is beyond our reasonable control.
Limitation of liability
You agree that your use of the platform is at your sole risk and that you are responsible for all costs associated with your access to, or use of, the platform. FiddAsia Advisory Ltd., its directors, employees, partners, affiliates or any other representative will not be liable for any damages, losses, costs, claims or demands of any kind, whether direct, indirect, compensatory or consequential, related to your use of this platform or the information content, materials or products included on this platform. These terms are governed by Thailand law and any dispute will be resolved exclusively by the Thailand courts.
FiddAsia Advisory Ltd. indemnitees shall not be liable to you for any losses whatsoever or howsoever caused (regardless of the form of action) arising directly or indirectly in connection with:
- Any access, use and/or inability to use the Platform or the Services;
- Reliance on any data or information made available through the platform and/or through the Services. You should not act on such data or information without first independently verifying its contents;
- Any system, server or connection failure, error, omission, interruption, delay in transmission, computer virus or other malicious, destructive or corrupting code, agent program or macros;
- Any use of or access to any other website or webpage linked to the platform, even if we or our offices or agents or employees may have been advised of, or otherwise might have anticipated, the possibility of the same.
- At your own risk. Any risk of misunderstanding, error, damage, expense or losses resulting from the use of the platform is entirely at your own risk and we shall not be liable therefor.

You acknowledge that you have read this agreement, understand it and will be bound by its terms and conditions.
